OpenCourses.AI Terms of Service

Draft for legal review. This document is intended as the first operational

version of the OpenCourses.AI Terms of Service. It should be reviewed by legal

counsel before formal launch, institutional partnerships, paid services, or

large-scale international use.

Overview

OpenCourses.AI is an open online learning platform designed to help learners access structured courses, follow learning paths, complete units and quizzes, track progress, express interest in courses, rate completed courses, and obtain completion evidence when available.

OpenCourses.AI may also include AI-assisted educational features connected to ALI, Adaptive Learning Intelligence, including course recommendations, learning profile signals, adaptive learning paths, course generation support, notebook rendering, and future personalization features.

These Terms of Service ("Terms") govern your access to and use of OpenCourses.AI, including the website, applications, course catalog, learner dashboard, course pages, learning units, quizzes, certificates or completion evidence, verification pages, administrative tools, course publishing tools, APIs if offered, and related services (collectively, the "Services").

By creating an account, signing in, accessing, uploading, importing, publishing, or using any part of the Services, you agree to these Terms.

Relationship Between These Terms and Other Policies

These Terms provide the general rules for using OpenCourses.AI.

Your use of the Services is also subject to:

  • the OpenCourses.AI Privacy Policy;
  • any content policy, course publishing policy, or acceptable use policy shown in

the product;

  • any product-specific or institution-specific terms that apply to a particular

program, integration, course, or organization;

  • any separately signed agreement between OpenCourses.AI and an institution,

organization, or customer.

If product-specific or institution-specific terms conflict with these Terms, the more specific terms control for that specific Service, feature, institution, or program.

The Privacy Policy explains how OpenCourses.AI collects and processes personal information. The Privacy Policy is a separate document and should be reviewed carefully before using the Services.

Scope of the Services

The Services may include:

  • public course catalog pages;
  • learner accounts and profiles;
  • onboarding and learning goal collection;
  • course enrollment;
  • progress tracking;
  • learning units;
  • notebook-based learning units;
  • quizzes and assessment attempts;
  • course interest signals;
  • course ratings;
  • learner dashboards;
  • course completion evidence;
  • certificate-like downloadable records;
  • public verification pages;
  • administrative course management;
  • user management for administrators;
  • course import and publishing tools;
  • AI-assisted recommendations or adaptive learning features;
  • contact and support forms;
  • other educational features added over time.

OpenCourses.AI may add, remove, modify, suspend, or discontinue Services or features at any time, subject to applicable law and any separately agreed terms.

Creating an account does not guarantee access to every feature. Access may depend on your role, course availability, location, technical compatibility, institutional permissions, moderation decisions, or service availability.

Accounts and Responsibilities

You may need an account to enroll in courses, save progress, complete quizzes, receive completion evidence, rate courses, publish content, or access administrative features.

You agree to provide accurate information, keep your credentials secure, and promptly notify OpenCourses.AI if you suspect unauthorized access to your account.

You are responsible for activity under your account, including activity involving courses, quizzes, ratings, uploads, imports, publications, and administrative actions.

You must not:

  • impersonate another person, institution, or organization;
  • create accounts for abuse, spam, scraping, manipulation, or security testing

without authorization;

  • share credentials in a way that bypasses access controls;
  • access or attempt to access non-public areas of the Services without permission;
  • interfere with the operation, integrity, or security of the Services.

If you use the Services on behalf of an institution, company, research group, school, university, or other organization, you represent that you are authorized to bind that organization to the applicable terms. In that case, "you" refers to both you and the organization.

Legal Acceptance at Account Creation

Creating an account requires acceptance of these Terms and the Privacy Policy.

OpenCourses.AI may store the version accepted, the acceptance timestamp, and related technical records for audit, compliance, and security purposes.

If these Terms or the Privacy Policy are materially updated, OpenCourses.AI may require renewed acceptance before continued use of the Services.

Age Requirements

OpenCourses.AI is not intended for children under 13 years old.

If you are under 13, you must not create an account or submit personal information. If you are between 13 and 17, you may use the Services only with permission from a parent, guardian, or authorized educational institution.

If OpenCourses.AI learns that it has collected personal information from a child under 13 without appropriate consent, it may suspend the account and delete the information, subject to legal and operational requirements.

If OpenCourses.AI later offers institutionally managed programs for minors, additional consent, student data, institutional, and child-protection controls may apply.

Educational Use and No Professional Advice

OpenCourses.AI provides educational and informational content. It does not provide professional advice.

Content related to health, medicine, psychology, law, finance, engineering, cybersecurity, safety, public policy, or other sensitive subjects is for learning purposes unless expressly stated otherwise. It should not be used as a substitute for qualified professional advice, institutional review, medical care, legal advice, financial advice, engineering review, security review, or safety approval.

You are responsible for how you interpret and use course content, notebooks, code, datasets, model files, AI outputs, quizzes, recommendations, and completion evidence.

Course Completion Evidence and Certificates

OpenCourses.AI may issue completion evidence, certificate-like records, downloadable documents, verification codes, or public verification pages.

Unless expressly stated otherwise, these records:

  • confirm learning activity completed within OpenCourses.AI;
  • are not academic degrees;
  • are not official university credits;
  • are not professional licenses;
  • are not government-recognized certifications;
  • do not guarantee employment, admission, promotion, academic credit, or

professional qualification.

OpenCourses.AI may correct, revoke, invalidate, or limit access to completion evidence if it was issued because of error, fraud, abuse, technical failure, identity misrepresentation, assessment manipulation, or violation of these Terms.

User Content and Course Content

Users may create, upload, import, generate, submit, publish, or otherwise provide content through the Services, including:

  • course packages;
  • course descriptions and metadata;
  • text;
  • notebooks;
  • code;
  • quizzes;
  • PDFs;
  • images;
  • diagrams;
  • audio;
  • datasets;
  • model files;
  • prompts;
  • ratings;
  • comments or support messages;
  • other educational materials.

You retain any rights you have in your content. By submitting content to OpenCourses.AI, you grant OpenCourses.AI a non-exclusive, worldwide, royalty-free license to host, store, copy, process, display, distribute, technically adapt, analyze for safety or quality, and make the content available as needed to operate, secure, improve, and provide the Services.

This license is limited to operating and improving OpenCourses.AI and related educational services. It continues for as long as needed to provide the Services, maintain backups, preserve audit logs, enforce these Terms, resolve disputes, comply with law, maintain completion evidence, or protect users and the platform.

You represent and warrant that:

  • you have the rights needed to submit, upload, import, or publish the content;
  • your content does not infringe copyright, trademark, privacy, publicity,

database, contractual, or other rights;

  • your content complies with these Terms and applicable law;
  • your content does not contain malware, hidden harmful instructions, or

unauthorized tracking;

  • your content does not include personal information of third parties unless you

have a lawful basis and all required permissions.

Course Publishing Responsibilities

If you create, import, generate, or publish a course, you are responsible for ensuring that the course is lawful, safe, educationally appropriate, properly licensed, and suitable for its intended audience.

Before publishing or importing a course, OpenCourses.AI may require you to confirm that:

  • you have the rights to publish the course content;
  • all third-party materials are properly licensed or authorized;
  • the course complies with the OpenCourses.AI content policy;
  • the course does not contain prohibited content;
  • the course does not misrepresent institutional approval, accreditation, or

authorship.

OpenCourses.AI may reject, keep in draft status, depublish, remove, restrict, or review courses that create legal, safety, quality, copyright, privacy, or reputational risk.

AI-Assisted Features and ALI

OpenCourses.AI may use AI systems to support course generation, course review, recommendations, summaries, translations, adaptive learning signals, feedback, quality checks, or other educational functions.

AI-generated or AI-assisted content can be incomplete, inaccurate, biased, unsafe, or unsuitable for a particular learner, course, institution, or context.

Users who create or publish courses are responsible for reviewing, validating, and correcting AI-assisted materials before publication or use in consequential settings.

OpenCourses.AI may use learning profile signals, course activity, progress, quiz performance, interests, ratings, and other educational signals to improve recommendations and prepare adaptive learning experiences. OpenCourses.AI does not guarantee learning outcomes, academic results, or professional outcomes.

Notebooks, Code, Datasets, and Model Files

Some courses may include notebooks, code, datasets, model files, dependencies, or other executable resources.

OpenCourses.AI may render notebooks for learning purposes. Execution may occur in external environments such as Colab, Jupyter, institutional infrastructure, a learner's local machine, or temporary execution environments operated for OpenCourses.AI.

When OpenCourses.AI provides a temporary lab, the environment is intended for educational exercises only. Labs may have time, CPU, memory, network, storage, dependency, and concurrency limits. Lab sessions may be stopped, expired, reset, or removed automatically. Workspaces are temporary unless the platform explicitly provides a persistence feature.

You are responsible for reviewing code before executing it. OpenCourses.AI does not guarantee that notebooks, code, dependencies, datasets, or model files are free from errors, vulnerabilities, bias, license restrictions, unsafe behavior, or unexpected costs.

Users must not upload or publish malicious code, credential-stealing code, unauthorized scraping tools, exploit deployment instructions, destructive automation, or other harmful software.

Prohibited Content and Conduct

OpenCourses.AI is intended for constructive educational use. You must not create, upload, import, publish, distribute, request, promote, or facilitate content or activity involving:

  1. Weapons and physical harm
  • Instructions to build, obtain, modify, conceal, or use weapons.
  • Instructions to cause injury, sabotage, poisoning, or violent harm.
  1. Illegal activity
  • Crime, evasion of law enforcement, trafficking, forged documents, fraud,

money laundering, or other unlawful conduct.

  1. Cyber abuse
  • Malware, credential theft, phishing, unauthorized access, exploit deployment,

ransomware, botnets, evasion, or compromise of systems.

  • Defensive cybersecurity education may be allowed when framed responsibly and

without enabling abuse.

  1. Sexual exploitation and minors
  • Sexual content involving minors or any exploitation, grooming, coercion, or

abuse.

  1. Hate, harassment, and abuse
  • Content that promotes hatred, dehumanization, targeted harassment, or

violence against protected classes or individuals.

  1. Self-harm
  • Instructions, encouragement, or methods for self-harm, suicide, or eating

disorder abuse.

  1. Unsafe sensitive advice
  • Risky medical, legal, financial, engineering, cybersecurity, or safety

instructions presented as professional advice without appropriate context, limitations, and safeguards.

  1. Privacy violations
  • Doxxing, non-consensual disclosure of personal data, stalking, surveillance,

or misuse of private information.

  1. Intellectual property violations
  • Pirated books, unauthorized course copies, copyrighted images, proprietary

datasets, license-incompatible code, or third-party materials without rights.

  1. Academic dishonesty
  • Content primarily designed to help users cheat, impersonate students,

bypass proctoring, fabricate credentials, or submit work deceptively.

  1. Spam and manipulation
  • Fake ratings, fake enrollments, deceptive course metadata, automated abuse,

or manipulation of platform rankings.

  1. Security or platform abuse
  • Attempts to bypass authentication, scrape non-public data, overload systems,

reverse engineer protected services, or interfere with the Services.

OpenCourses.AI may remove, restrict, label, reject, or depublish content that violates this policy or creates legal, safety, reputational, or operational risk.

Moderation and Enforcement

OpenCourses.AI may, at its discretion:

  • review content, accounts, courses, packages, or activity;
  • reject course imports;
  • keep courses in draft status;
  • depublish courses;
  • remove or disable access to content;
  • suspend or terminate accounts;
  • revoke or correct completion evidence;
  • preserve records for legal, safety, audit, or security purposes;
  • report unlawful activity when required or appropriate.

OpenCourses.AI is not obligated to monitor all content, but may do so to operate, secure, enforce, and improve the Services.

Copyright and Takedown Requests

If you believe content on OpenCourses.AI infringes your rights, contact:

Include:

  • your name and contact information;
  • identification of the copyrighted or protected work;
  • the URL or location of the allegedly infringing content;
  • a statement explaining your rights and the alleged infringement;
  • any supporting evidence.

OpenCourses.AI may remove or restrict content while reviewing a claim.

Institutional Use

Institutions using OpenCourses.AI remain responsible for their own academic policies, student consent processes, accessibility obligations, intellectual property review, faculty authorization, data protection obligations, and compliance with applicable law.

OpenCourses.AI may provide tools for course publication, package validation, progress tracking, completion evidence, and verification. These tools do not replace institutional review or legal compliance.

Third-Party Services

OpenCourses.AI may integrate with or link to third-party services such as Google sign-in, email providers, hosting providers, analytics tools, external notebook execution environments, Colab, GitHub, Jupyter, dataset providers, model providers, or institutional systems.

Third-party services are governed by their own terms and privacy policies. OpenCourses.AI is not responsible for third-party services, outages, content, security incidents, or data practices.

Service Evolution and Updates

OpenCourses.AI is continuously evolving. We may update, modify, suspend, limit, or discontinue Services, features, content, integrations, course formats, or technical requirements at any time.

We may also update these Terms to reflect changes to the Services, legal requirements, operational practices, safety needs, or business needs.

If changes are material, OpenCourses.AI may notify users or require renewed acceptance. Continued use of the Services after updated Terms become effective means you accept the updated Terms.

Availability

The Services may experience outages, interruptions, errors, delays, data loss, maintenance windows, security incidents, or compatibility issues.

OpenCourses.AI does not guarantee uninterrupted availability, permanent storage, or compatibility with all browsers, devices, notebooks, datasets, dependencies, or execution environments.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, OpenCourses.AI is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

OpenCourses.AI does not warrant that:

  • content will be accurate, complete, safe, or current;
  • AI-generated outputs will be reliable or error-free;
  • courses will meet a learner's needs;
  • completion evidence will be accepted by third parties;
  • notebooks, code, datasets, or model files will execute correctly;
  • the Services will be uninterrupted or secure against every possible risk.

Limitation of Liability

To the maximum extent permitted by applicable law, OpenCourses.AI and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, loss of profits, loss of opportunity, academic consequences, employment consequences, reputational harm, or damages arising from reliance on course content, AI outputs, user-generated content, third-party services, or execution of notebooks or code.

This limitation does not exclude liability that cannot be excluded under applicable law.

Indemnity

If you create, import, upload, publish, or distribute content through OpenCourses.AI, you agree to be responsible for claims, losses, liabilities, damages, costs, and expenses arising from your content, your misuse of the Services, your violation of these Terms, or your infringement of third-party rights, to the extent permitted by applicable law.

Termination

You may stop using OpenCourses.AI at any time. You may request deletion of your account by contacting OpenCourses.AI, subject to retention needed for legal, security, audit, completion evidence, fraud prevention, or operational purposes.

OpenCourses.AI may suspend or terminate access if it believes you violated these Terms, created risk, abused the Services, infringed rights, or used the platform unlawfully.

Governing Law

Unless a separate written agreement says otherwise, these Terms are governed by the laws of [GOVERNING_LAW_JURISDICTION], without regard to conflict-of-law rules.
